Appeal Court: Saraki Withdraws Application Against CCT Trial

Senate President Bukola Saraki has withdrawn an application to stall his trial at the Code of Conduct Tribunal (CCT) pending the hearing of his suit at the appeal court. The senate president is facing trial at the CCT for alleged false declaration of assets.

On Monday at the appeal court, Kanu Agabi, Saraki’s lead counsel, withdrew the application and asked the court to grant accelerated hearing to his appeal challenging the jurisdiction of the CCT to try his client. “When your lordship has read such a voluminous motion, it is unfair to say we are withdrawing. But we have to. We want to withdraw the motion,” he said.

“In the motion, dated April 4, we prayed your lordship to stay proceedings at the CCT pending the hearing of our appeal. But we now want to urge your lordship to grant accelerated hearing to our appeal. “My Lord, we appeal to you to grant us accelerated hearing.”

There is Grazing Reserve Commission Bill In The Senate As Saraki Presides Over Session Ahead Of CCT Trial

Senate President , Bukola Saraki on Tuesday briefly presided over the plenary session of the house before leaving to attend his trial at the Code of Conduct Tribunal (CCT) sitting in Abuja.

He came into the chambers at 10.48am and the session took off with the opening prayer.

Deputy Senate President, Ike Ekweremadu, took over from Saraki when he left the seat.

During the session, the controversy trailing a supposed bill to create a Grazing Reserve commission for cattle breeders in the country was raised by the Senator representing Abia South Senator Enyinnaya Abaribe..

Abaribe, said to the best of his knowledge, there is no such bill by the name before the Senate.

Court Ruling: Senate President Saraki Loses Appeal To Stop CCT Trial

The Nigeria's Court Of Appeal has today rules that the Senate President, Senator Olubukola Abubakar Saraki’s trial should proceed. Hence, the appeal court sitting in Abuja dismissed an appeal brought before it by Saraki to stop his trial at the Code of Conduct Tribunal (CCT).

Appeal court on Friday, October 30, 2015 dismissed the argument of Saraki that the CCT was not a court of competent jurisdiction to handle the criminal charges preferred against him.

 “The CCT is a court of criminal jurisdiction, albeit limited jurisdiction, stated the court in its judgement today.

According to the Judgment statement: “The immediate question is whether it is a court or not. There is no inherent difference between a court and a tribunal. The only difference is that tribunals in most cases handle special cases. “The tribunal has power to impose sanctions according to the law. It is a court with specific criminal jurisdiction.”

Nigeria's National Assembly is set to begin the process of Constitution amendment towards ensuring immunity for heads of the three arms of government.

To also benefit from the immunity, when the Constitution is amended, are the Deputy Senate President, Speaker of the House of Representatives, his deputy and the Chief Justice of the Federation (CJN).

The Senate President, Bukola Saraki, was recently docked by the Code of Conduct Tribunal (CCT) over the alleged falsification in his asset declaration over 10 years ago.
